Nordin Kardi’s and UUM’s reputations worth RM4mil

That’s not much. But it’s what the court has awarded the vice-chancellor of Universiti Utara Malaysia and the university — RM2mil each. That’s how much Raja Petra of super-popular political website Malaysia Today has to pay.

An excerpt from MT:

The court’s decision, however, is not based on what I am worth. It is based on what Nordin Kardi and UUM are worth, or rather what their reputations are worth. I was alleged to have smeared Nordin’s reputation as well as that of all Malaysian universities plus the intellectuals who are heading them. In a way, Nordin filed a sort of ‘class action suit’ against me to defend not only his reputation, and not only UUM’s reputation, but that of all Malaysian universities and all Malaysian intellectuals who are heading these universities. And the court has valued these combined reputations as a mere RM4 million.

Hmmm, sounds like PKR dragged poor RPK into this. Anyway, another day in journalism. ;) That’s all they know — to sue. Well, lesson learned: always have proof if writing controversial factual claims. :)

Hope all is well, RPK. Much still needs to be done to expose the truth about Malaysia.

    Oh mama, RPK really takes the pants of Nordin:

    “Then Nordin Kardi made his statement and he went on and on about how blogs have smeared the reputation of intellectuals such as himself. Hello…….since when is he an intellectual? If he is an intellectual then Madonna is a virgin.”

    This even worse than what Nordin sued RPK for. How on earth is Nordin going to walk around in th campus - he`s the laughing stock there. `Virgin Madonna` hahaha.

    GE is over, but `Keris` Muddin and his die-hard Education Ministry are still battling:

    PENANG (March 26, 2008): Schools in the five states controlled by the opposition coalition have been verbally adviced to take a neutral stance in inviting executive councillors or state assemblyman for official functions.

    And this is being interpreted to mean that the schools should refrain from inviting executive councillors or assemblymen from opposition parties, at least until further notice.

    I wouldn’t be too worried if I was RPK. The judge made a fundamental mistake in her judgment. It is textbook law that for a judgment in default of a cause of action like defamation, you can only enter a judgment for damages to be assessed. You cannot enter a fixed sum in damages for judgment in default of appearance for a cause of action like defamation.

    Any rookie first year lawyer knows that. It just goes to show how low the standard of the judiciary is. The judge should resign and go back to law school.

    RPK was right in ignoring this case. Legally, this case should not even be brought up in a Malaysian court as it has no jurisdiction over the alleged libel. The said article was published in a non-Malaysian media, as MT site does not reside in Malaysia and not even a registered entity in Malaysia. Technically, this case doesn’t exist in Malaysia. What Nordin Kardi and the judge presiding in this suit is doing is just a case of “intellectual masturbation” where the “actors” in this “judicial charade” can only “syiok sendiri”. There is no legal ground to enforce the judgement. I wonder where the judge got her law degree as it seems that she does not even understood the very basic concept of “jurisdiction”.

    llk - actually, your argument on jurisdiction is not entirely correct. There is some authority for the Malaysian courts to say that they have jurisdiction see Dow Jones v Gutnick http://en.wikipedia.org/wiki/Gutnick_v_Dow_Jones
